AN ORDINANCE AMENDING CHAPTER 109 OF THE CODE OF THE TOWNSHIP OF WEST AMWELL, HUNTERDON COUNTY, NEW JERSEY – Developer Fee

BE IT ORDAINED by the Township Committee of the Township of West Amwell, Hunterdon County, State of New Jersey, that sections 109-24 and 109-25 of the Land Use Ordinance be amended to read:

1. 109-24. RESIDENTIAL DEVELOPMENT FEES

Within the Township of West Amwell, developers shall pay a development fee of one and one-half percent of equalized value for eligible residential activities pursuant section 109-27 of this article.

2. 109-25. NON-RESIDENTIAL DEVELOPMENT FEES

Developers within the Township of West Amwell shall pay a fee of three percent of equalized value for eligible non-residential activities pursuant section 109-27 of this article.

3. EFFECTIVE DATE

This Ordinance shall take effect immediately upon final passage and publication as provided by law, and upon filing a copy thereof with the Hunterdon County Planning Board in accordance with N.J.S.A. 40:55D-16.

NOTICE OF PENDING ORDINANCE

The Ordinance published herewith was introduced and passed on first reading at a meeting of the governing body of the Township of West Amwell, in the County of Hunterdon, State of New Jersey, held on May 7, 2008. It will be further considered for final passage, after public hearing thereon, at a meeting of the governing body to be held in the municipal building, 150 Rocktown-Lamb. Rd., Lambertville NJ on June 4, 2008 at 7:45 p.m. All interested parties will be heard at this time.
