WEST AMWELL TOWNSHIP BOARD OF HEALTH MEETING
May 26, 2004
The West Amwell Township Board of Health met on the above date during a break in
the regular Township Committee meeting.
The meeting was called to order at 9:55 p.m. and was declared in compliance with
the Open Public Meetings Act by annual notice having been published in the
Trenton Times and the Lambertville Beacon on January 29, 2004 and posted on the
Township bulletin board. Special notice of the change of date
was faxed to the Trenton Times and Lambertville Beacon on April 22, 2004 and
posted accordingly. The Municipal Building is handicapped accessible but the
Board office should be contacted 24 hours in advance for any special
accommodations.
Present: Gary W. Bleacher, Nancy Palladino, Peter A. Buchsbaum, Peggy Cekoric,
Attorney Faherty, Ken Hart, Secretary Olsen, Betty Jane Hunt and three members
of the public, Hal Shute, Desmond O'Neil and Margaret Carmelli.
SWEARING IN OF NEW APPOINTMENT:
Mrs. Cekoric was sworn into office by Attorney Faherty. Mrs. Cekoric fills the
required position of physician/school nurse. The appointment is for three years.
MINUTES:
Olsen stated a typo found in the Board's copy of the minutes has been corrected
on the official copy. That noted, the minutes of the March 17, 2004 regular
meeting were approved on motion from Buchsbaum and seconded by Bleacher. Roll
call: Hart-aye, Cekoric-abstain, Buchsbaum-aye, Palladino-aye, Bleacher-aye.
AGENDA REVIEW:
There was nothing to be added to the agenda.
OPEN TO THE PUBLIC:
There was no comment from the public.

RESOLUTIONS:
RESOLUTION 02-2004
WHEREAS at the May 2003 meeting of the BOH, a policy was made regarding the
refund of STW fees, and
WHEREAS the policy stated that
1. the second day had to be cancelled by the end of the first day of testing
with a
call to the secretary
2. an administration fee of $35.00 would be deducted from the refund OR
3. credit would be given for another testing date scheduled within 30 days
on same Block and Lot, and
WHEREAS at the December 2003 meeting this policy was further amended to apply
the administrative fee to all subsequent days cancelled in line with the May
guidelines, and
WHEREAS the following applicants meet the above qualifications for second
and/or subsequent-day refund minus the administration fee

Buchsbaum moved for approval and Palladino seconded. Roll call: Hart-aye,

UNFINISHED BUSINESS:
NJDOT Yard - Parsons
The 1st quarter 2004 report of the groundwater treatment system revealed a total
mass removed of 17.3 lbs. and a total to date of 726.9 lbs.
Chemical sampling of the Nanni, Muller and Ruggieri wells for volatile
organic compounds will be accomplished between June 7 and 8 to comply with NJDEP
sampling requirements.
STW Cancellation Pay
The secretary checked with Raritan Township and witnesses are not paid for
cancelled days.
Cat Holding Facility
Tabby's will not take our strays. ACO Hoagland had all ready covered this
option. However, if we are ready to put a cat down, they will accept it.
No ferel cats though.
Update on Dog Facility; Letter from Dr. Maxim
A letter was received from Dr. Maxim concerning care of injured animals. For
logistical and insurance reasons he cannot provide this service. He will do the
Rabies clinics. The secretary noted that another veterinary group was
looking at the Muller facility. One of the vets visited the office and
indicated interest in continuing service to the Township if the deal goes
through.
NEW BUSINESS:
Seasonal Water Request from Sadat
One of the salt litigants has again requested that water be provided for their
pool. It was noted that the circumstances are a bit different this year;
however, the Board approved the request. Sadat will be notified.
Chapter 173 Proposed Revisions
Buchsbaum and Hart met earlier in the month to look at Chapter 173 and the
additions and changes that have been proposed. These were incorporated into the
existing ordinance in italics. The secretary noted a concern from Road
Supervisor Hoagland regarding the destruction of Township ditches during
property access. The Board agreed that this concern will be added to the
ordinance. The Board briefly discussed the pros and cons of having a reserve
area included in the ordinance, e.g., may preclude clustering, difficulty in
obtaining a single perc on some lots, concerns about recharge and nitrate
dilution; that things should be better going forward as the new systems appear
to be working. A reserve area was not recommended at this time. Although the
additions will improve the subdivision/STW checks, the
single lot application after STW is still an open issue. The secretary was
instructed to send the proposed revisions to Clerico for his comments and to
prepare an ordinance for introduction.
The secretary noted a recent problem with a STW applicant. The applicant was
directed to write to the Board but nothing has been received.
SOIL TEST WITNESSING REPORT:
The March, April and May 2004 reports were received without comment or
question by the Board. Total fees received were $5200.00.
CLOSED SESSION AND RESULTS OF CLOSED SESSION, IF ANY:
A closed session was not needed at this time.
CORRESPONDENCE:
The following items were received from the Hunterdon County Health
Department:
- Notices of septic repair was received for Block 30 Lot 6 and Block Lot 74.
The former involved a crushed pipe, the baffle, riser and connecting line.
The latter was part of a demolition project with D & R
Greenway/State of NJ.
- ESC, Quick Chek, South Hunterdon HS (Dowling Food Service), West Amwell
Fire Company, West Amwell Elementary (Dowling Food Service)
all received satisfactory Sanitary Inspection Reports
- Kennel inspections were completed for Pearson Creek, Rock Road, Amwell
Valley Conservancy. All were found satisfactory.
- A letter was received from Jim Gallos concerning the soil test witnessing
notes that were sent to him recently. He stated that the County relies on the
professional engineer to ensure that equirements have been met; that witnesses
are in the field to verify and rectify the testing; and
that if there's no resolution in the field that the witness should forward the
procedure in question, with an explanation, to the County for their application
pending file.
ACO Hoagland has submitted her report on the May 1, 2004 Rabies clinic. There
were 38 dogs and 22 cats vaccinated.
DISCUSSION:
The secretary noted that the subcommittee asked that a cover letter be prepared
to accompany the mandatory mailing on septic system operation and maintenance
practices. A draft letter was presented and suggestions made.
A revised letter will be prepared and forwarded to the Board for approval.
Hart inquired about the status of the soil removal at the Township garage and if
this soil could be mixed and re-used on the roads. This question will be shared
with the consultant.
ADJOURNMENT:
There being no further business before the Board, the meeting unanimously
adjourned at 10:35 p.m.
