WEST AMWELL TOWNSHIP BOARD OF HEALTH MEETING July 16, 2003

9:00 p.m. (time approximate)

The West Amwell Township Board of Health met on the above date during a temporary adjournment of the regular Township Committee meeting.

Chair Buchsbaum called the meeting to order at 11:45 p.m. The meeting was declared in compliance with the Open Public Meetings Act by annual notice having been published in the Trenton Times and the Lambertville Beacon on January 23, 2003 and posted on the Township bulletin board.

Present: Peter A. Buchsbaum, Gary W. Bleacher, Nancy Palladino, Rick Kropp, Attorney Faherty, Secretary Olsen, Betty Jane Hunt, Gregg Barkley and Marvin Levy

MINUTES:

The minutes of the May 21, 2003 meeting were approved as received on motion from Buchsbaum and seconded by Bleacher. Roll call: Kropp-aye, Palladino-aye, Bleacher-aye, Buchsbaum-aye.

AGENDA REVIEW:

There were no additions to the agenda.

NEW BUSINESS:

Septic Alteration Design, Block 31 Lots 8 & 9 - Gregg Barkley:

Gregg Barkley of Russell Reid Engineering appeared before the Board to request a waiver for the referenced property on Barry Road. The Board was supplied with a copy of the site and design plan as well as the application for construction of a new subsurface sewage disposal system that was submitted to the County Health Department. Mr. Barkley stated that the Levy’s have lived in the house for 30 years and are the original owners. The existing disposal system is working but the Levy’s are looking for a new system for future resale purposes. Mr. Barkley stated that there are problems with mottling due to regional ground water with the static water level being 96" below grade. A new system will definitely be a mound. He stated that the well is out of 100 ft. radius and that the property to the rear of this one is undeveloped and that the distances and situations of neighboring systems are not a problem. The waiver being sought is due to the “regional zone of saturation being less than 24 inches”.

Kropp motioned to approve the waiver as stated in the County Health Department’s letter of June 30th and Bleacher seconded. Roll call: Kropp-aye, Palladino-aye, Bleacher-aye, Buchsbaum-aye.

Septic Management/ANJEC:

This item was held over to the next meeting of the Board.

UNFINISHED BUSINESS:

NJDOT Yard - Renewal Application for NJPDES Discharge Permit:

Parsons has applied for renewal of their Discharge to Surface Water Permit for the treatment system remediating a plume of MTBE at the NJDOT yard off of Route 179.

Status of Well Testing/Next Round:

The next round of well testing has been scheduled for July 28. The same eight wells will be tested.

Chapter 173 - Continued Discussion on Soil Test Witnessing:

This item was held over to the next meeting of the Board in September.

CORRESPONDENCE:

The following items were received from the Hunterdon County Health Department:

- The Department takes no exception to the proposed minor subdivision of Block 17 Lot 39.01 (Corboy) as the site plan review and soil testing conducted was found to be in full compliance with NJAC 7:9A.

- The Sanitary Inspection Reports for ESC, The Market Grill, and Pine Creek reveal satisfactory evaluations.

Letters were received from Gerald M. Rygg of 1 Rose Run. The first concerned seepage from his sand mound septic system. This was forwarded to the County Health Department for investigation. The County performed a dye test on the system and nothing showed up. Anita reported that the yards are wet and that this may be a drainage problem due to the swale and spring rains and was referring the matter to the Township Engineer. Betty Jane Hunt spoke with Mike Karmatz and Bob Clerico. Clerico will review the engineering and Karmatz will see to the developer’s responsibility here, if any.

The second involved questions concerning permits for a proposed in-ground lawn sprinkling system and swimming pool for the Rygg property, given that their well has only a 4 gpm capacity. The secretary informed the Board that she sent Mr. Rygg a copy of Chapter 168 and forwarded a copy of their letter to the Construction Official.

SOIL TEST WITNESSING:

The May and June Reports were received without comment or questions by the Board.

CLOSED SESSION & RESULTS OF CLOSED SESSION, IF ANY:

A closed session was not needed at this time.

DISCUSSION:

Palladino related her displeasure with the soil test witnessing fees and credit policy currently in place.

ADJOURNMENT:

There being no further business before the Board, the meeting was unanimously adjourned at 12:15 a.m.
